Maryland hurricane deductible rules

When the hurricane deductible applies in Maryland and what it can be, summarised from official state sources.

Maryland in brief

Maryland applies a mandatory percentage hurricane deductible statewide once a hurricane warning is issued for any part of the state, ending 24 hours after the last warning ends, and bars insurers from requiring more than 5% of the dwelling limit unless the standard is filed with the Commissioner.

When the deductible applies

Under Insurance Article section 19-209, a mandatory hurricane deductible applies from the time a hurricane warning is issued for any part of Maryland until 24 hours after the last hurricane warning for any part of the state ends, regardless of where in the state the home is located.

The 5% limit

An insurer may not adopt an underwriting standard that requires a hurricane deductible above 5% of the dwelling (Coverage A) limit unless the insurer has filed that standard with the Maryland Insurance Commissioner.

Notice

Section 19-209.1 requires a percentage deductible notice when the policy is first issued and at each renewal, describing the deductible and when it applies.

What a 2% deductible costs

A percentage deductible is applied to the dwelling coverage limit (Coverage A), not to the damage. On $300,000 of dwelling coverage a 2% deductible is $6,000; on $500,000 it is $10,000. Covered storm damage below that amount is paid by the homeowner.

Example 2% deductible: $300,000 of dwelling coverage gives $6,000; $500,000 gives $10,000.
